Trademark and Copyright Registration — Key Questions
UAE trademark registration gives the owner exclusive rights to use the mark in connection with the registered goods or services categories within the UAE. It provides the legal basis to prevent third parties from using identical or confusingly similar marks, to take enforcement action including Customs recordal to block infringing imports, and to license the mark to others. Without registration, brand protection relies on the weaker common law position of prior use.
From filing to registration, the process typically takes six to twelve months, assuming no oppositions are filed during the publication period. The Ministry of Economy publishes accepted applications for a statutory period during which third parties can oppose the registration. If the application proceeds without opposition, the registration certificate is issued. Opposed applications take longer to resolve.
UAE trademark registrations are valid for ten years from the filing date and can be renewed indefinitely for further ten-year periods. Non-use for a continuous period of five years following registration can make the mark vulnerable to a cancellation action by a third party. Active use and timely renewal are essential to maintaining protection.
Yes. A trademark registered with the UAE Ministry of Economy covers all seven emirates and the UAE mainland. Separate registration is required in DIFC (regulated by DIFC Courts rules) for trademark protection specifically within that jurisdiction. Freezone-specific marks are less common — most clients register nationally with the Ministry of Economy.
